By accessing the Nourishing Roots: Mind, Body, Spirit Inc. website, you agree to be bound by these terms and conditions ("Terms") and our Privacy Policy. If you do not accept all of these Terms, then you may not use our website and services. By accessing or using this Website, you agree to this Policy. This Policy may change from time to time. Your continued use of this Website after we make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates.

 

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ACCESSING, USING OR OBTAINING ANY MATERIALS, INFORMATION, SERVICES OR PRODUCTS. 

 

LIABILITY RELEASE

I, The Client, hereby releases, indemnifies, and holds harmless, the Service Provider (Nourishing Roots: Mind, Body, Spirit Inc.) from any and all manner of actions, causes of action, suits, proceeding, debts, dues, contracts, judgments, damages, claims, and demands whatsoever in law or equity stemming from the agreement between the below-mentioned parties. The Client expressly agrees that this release, waiver, and indemnity clause are intended to be broad and inclusive, and if any portion thereof is held invalid, it is agreed the balance shall notwithstanding, continue in full legal force and effect. The Client has carefully read the foregoing release and indemnification clause and understand the contents thereof. The Client acknowledges and is made fully aware that Nourishing Roots: Mind, Body, Spirit Inc. is not a medical doctor and that the Service Provider is only providing recommendations to The Client in question. The Client acknowledges before beginning, implementing, or using any and all of the recommendations provided, that client should consult a medical doctor.

 

Nourishing Roots: Mind, Body, Spirit Inc., nor its staff, is not a physician, psychologist or physical therapist, and the scope of his/her consultation services does not include treatment or diagnosis of specific illnesses or disorders. If you, the client, suspect you may have an ailment or illness that may require medical attention, then you are encouraged to consult with a licensed physician without delay. Only a licensed physician can prescribe pharmaceuticals. Any mention of pharmaceuticals in the course of consultation is only for the purpose of providing a complete history of pharmaceuticals that the client is taking and not for Nourishing Roots: Mind, Body, Spirit Inc. to judge the appropriateness of the medication. Any change in prescription or dosage is a decision the client makes with his or her physician.

Rather than dealing with the treatment of disease, Nourishing Roots: Mind, Body, Spirit Inc. focuses on wellness and prevention of illness through the use of non-toxic, natural wellness therapies to achieve optimal health. As certified wellness coaches and functional nutritional therapy practitioners, Nourishing Roots: Mind, Body, Spirit Inc. primarily educates and motivates clients to assume more personal responsibility for their health by adopting a healthy attitude, lifestyle, and diet.

 

CLIENT NON-DISCLOSURE AGREEMENT

I shall hold and maintain the Confidential Information passed on to me during my time as a Nourishing Roots: Mind, Body, Spirit Inc. Client in strictest confidence, understanding it is for my sole and exclusive benefit. I shall carefully restrict access to Confidential Information (including all Electronic Communication, such as wellness programs) to third parties as is reasonably required. I shall not, without the prior written approval of Nourishing Roots: Mind, Body, Spirit Inc., publish, copy, or otherwise disclose to others, or permit the use by others for their benefit or to the detriment of Nourishing Roots: Mind, Body, Spirit Inc., any Confidential Information.

 

SUBSCRIPTION CANCELLATION POLICY

I understand that I may have signed up for a subscription service that is non-transferable and non-refundable. I can cancel my subscription at any time by notifying my professional at least 7 business days prior to my account bill date. I understand that I am responsible for the full subscription fee in the billing cycle for which I cancel.*

 

*Clients enrolled in a subscription program agree to a four month commitment minimum. After you’ve completed four months you may cancel at any time.

 

I understand that Nourishing Roots: Mind, Body, Spirit Inc. closes for the following holidays and I expect to receive no communication or responses to documentation on these days: 

 

• President’s Day and the Friday before

• Good Friday

• Easter

• Memorial Day and the Friday before

• July 4th and Federal observance day if applicable

• Labor Day and the Friday before

• Thanksgiving Thursday-Friday

• December 20-January 2

 

There are no refunds, credits or pauses for these days.

 

I also understand that employees of Nourishing Roots: Mind, Body, Spirit Inc. may take holiday time at other points during the year. If this time will interrupt regular services, I understand Nourishing Roots: Mind, Body, Spirit, Inc. will make necessary accommodations to either provide the services during a time during or outside of the holiday period (this may include sending pre-recorded content instead of live content) or provide adequate time and/or monetary compensation (i.e. discount) for the time missed.

 

PAYMENTS

All payments to Nourishing Roots: Mind, Body, Spirit Inc. are handled securely. Products and subscriptions will be paid through Square, Wix, Paypal and any other third party payment source as deemed necessary.

 

Payment will be debited from your credit card or PayPal account immediately upon you placing the order for the product or subscription you have purchased. Upon processing a transaction, we will issue you with an electronic transaction receipt which will be sent to the email address you provide. 

Your payment information will be treated and safeguarded with total security and with the exclusive purpose of processing the purchase of the products and the subscriptions. Nourishing Roots: Mind, Body, Spirit Inc. reserves the right to contract any payment platform available in the market, which treats your data for the exclusive purpose of processing the purchases made through our sites and for our services.

REFUNDS

I understand that I have a right to request a refund, in writing, sent to my FNTP, instructor, or coach, if I have put in the time and effort necessary to fully try the program I have enrolled in and I am unsatisfied. I understand this means I must complete any and all necessary paperwork, attend 1:1 sessions, attend or watch the recordings of group sessions, and attempt the nutritional and lifestyle interventions provided. My refund request must provide evidence of these attempts and an explanation as to why I am dissatisfied. I understand I may be contacted by a Nourishing Roots: Mind, Body, Spirit Inc. employee to further discuss my dissatisfaction before a refund is issued.

 

PRICES

Nourishing Roots: Mind, Body, Spirit Inc. reserves the right to determine pricing for products and subscriptions. We will make reasonable efforts to keep pricing information published on the website up to date. We encourage you to check our website periodically for current pricing information. We may change the fees for any product or subscription, including additional fees or charges. We, at our sole discretion, may make promotional offers with different features and different pricing to any person at any given time.

 

ELECTRONIC ACKNOWLEDGEMENT

By accessing the Nourishing Roots; Mind, Body, Spirit Inc. website and registering for programs provided, I confirm that I have read, fully understand, and agree to the above disclaimer. I do not hold Nourishing Roots: Mind, Body, Spirit Inc. and its employees liable or responsible for any medical conditions or injuries that may result from the services they provide. I am in complete agreement thereto, and do freely and without duress sign and consent to all terms contained herein and I understand that this acknowledgement is considered a binding signature.
